Shooting Star Investment Fund NV

Pursuant to Article 54 of Legislative Decree 58/1998, Consob has prohibited the offering via the Internet site www.shooting-star.an of shares of Shooting Star Investment Fund NV , a Sicav established under the law of the Netherlands Antilles.

Analysis of the site showed that the company was offering shares in Italy without having fulfilled the obligations established in Article 42.5 of the Consolidated Law on Financial Intermediation for non-harmonized foreign collective investment undertakings (authorization to distribute products and clearance of the prospectus). In fact the site www.shooting-star.an was found to have many of the features specified in Consob Communication 99052838 for the purpose of identifying sites to be considered as aimed at investors resident in Italy. In particular, the site uses the Italian language; does not explicitly exclude the possibility of Italian residents making investments, shows the performance of the fund offered in relation to indicators referring to the Italian financial market (Mib30); and can be found using Italian search engines.
