Consob has ordered the black-out of 4 new websites that offer financial services/financial products illegally: 3 illegal financial intermediation websites and 1 website through which an offer of financial products is carried out in the absence of a prospectus.
The Authority availed itself of the powers deriving from the "Decreto crescita" ("Growth Decree" Law no. 58 of 28 June 2019, Article no. 36, paragraph 2-terdecies), relating to the black-out of the sites of abusive financial intermediaries, as well as of the power introduced by the Law no. 8 of 28 February 2020, Article no. 4, paragraph 3-bis, with reference to the black-out of the website through which the illegal offer is carried out.

The number of websites blacked out since July 2019, when Consob got the power to order that the websites of fraudulent financial intermediaries be blacked out, has thus risen to 815.

ACF, the composition of the College has been renewed - On 12 December the new effective members (4 out of 5) and alternate members (8 out of 10) will be in office
Starting from next 12th December, the composition of the decision-making Board of the Securities and Financial Ombudsman (ACF), the body set up at CONSOB for the out-of-court settlement of disputes between savers and intermediaries, will change.
In fact, a large part of the members of the Board, both effective and alternate ones, will be on 11th December at the natural expiry of their mandate, that has a duration of three years and can be renewed only once for further three years.
The new effective and alternate members are as follows:
Effective Members
- Professor Maria Debora Braga and Professor Lawyer Michele de Mari (both already substitute members) upon designation by CONSOB;
- Professor lawyer Francesco De Santis, appointed by the financial intermediary trade associations;
- Professor Paolo Esposito on nomination by the National Council of Consumers and Users (CNCU), the consumer representative body.
On the other hand, the ACF President, Gianpaolo Barbuzzi, whose five year term was renewed in December 2021 for further five years, remains in office.
Alternate members
- Professor lawyer Ugo Minneci, Professor Margherita Mori, Professor lawyer Giuseppe Santoni and Professor lawyer Anna Scotti upon nomination by CONSOB;
- Lawyer Nicoletta Mincato and Professor lawyer Roberto Rosapepe upon nomination by the trade associations of intermediaries;
- Professor lawyer Stefano Cherti and Professor lawyer Ugo Malvagna, upon designation by the CNCU.
Professor lawyer Philipp Fabbio and Professor Gustavo Olivieri also remain in office, both alternate members upon designation by Consob, the first appointed on 22th October 2020 and the other on 1st October 2018, then subsequently renewed on 1st October 2021 for further three years.

The Memorandum of Understanding (MoU) between Consob and the Guardia di Finanza has been renewed
The President of Consob, Professor Paolo Savona, and the General Commander of the Guardia di Finanza, Gen. C.A. Giuseppe Zafarana, today signed the renewal of the Memorandum of Understanding (MoU) which continues to strengthen cooperation between the two institutions.
At the same time, a conference was held this morning in favor of officers and managers, with the aim of investigating, in the light of technological evolution, the role of Artificial Intelligence in protecting the markets in their respective control activities.
The agreement will make it possible to deal with the risks arising from emerging threats, in relation to which prevention and contrast strategies can be jointly developed, also through the work of the technical tables set up for the study of specific phenomena.
Both authorities also undertake to strengthen the promotion of educational activities related to both professional training and external communication events.

Revision of the PRIIPs KID structured data in line with the application, from the 1st of January 2023, of Delegated Regulation (EU) 2022/975 17th of March 2022 and methods to acquire CIS KID by Consob pursuant to art. 34-bis.2 of the Issuers' Regulation
Amendments to Delegated Regulation (EU) 2017/653 will entry into force on the 1st of January 2023, thus affecting the structured data relating to PRIIPs which, pursuant Consob resolutions n.21639 and n.21640 of 15th December 2020, manufacturers of PRIIPs marketed in Italy shall make accessible to Consob by either SFTP or by web interface.
Since the revision of the abovementioned delegated acts impacts mainly on calculation methodologies and just slightly on the information to be represented into the KID, the amendments to the structured data set are limited.
The update of the structured data set will be applicable from the 1st of January 2023, coherently with the delegated acts revision starting date. The system go-live will be anticipated by a testing phase.
On Consob's website /web/services-for-supervised-subjects/procedure-of-communication-of-priips-kid will be published, within the 31st of October 2022, the revised Operating Instructions, the "Technical specifications for xsd schemes" and an updated version of the "Web Interface Manual"[1].
Moreover, starting from the 1st of January 2023, coherently with Regulation (EU) 2021/2259 of the 15th of December 2021 and the Directive (EU) 2021/2261 of the 15th December 2021, the KID PRIIP rules will be extended to the offering of UCITS and open AIF to retail investors.
With regard to CIS marketed to retail investors, KIDs shall be made available only through the DEPROF System pursuant to art. 34-bis.2 of the Issuers' Regulation, whose guidebook will be updated within the 31st of October 2022 on /web/services-for-supervised-subjects/filing-of-cis-offering-documents.
Finally, about CIS:
- PRIIP KID jointly with related structured data could be made available to Consob starting from the 15th of December 2022;
- From the 15th to the 31st of December 2022, if a UCITS KIID update happens, it shall be sent via e-mail at saivif@consob.it.
[1] It is worth to highlight that the "Annex 1 to the Operating Instructions" file has been deleted and substituted integrally by the "Technical specifications for xsd schemes" file.

CONSOB promotes in Italy the sixth edition of the World Investor Week (WIW), launched today by IOSCO
CONSOB promotes in Italy the sixth edition of the "World Investor Week" (WIW), conceived and promoted by the International Organization of Securities Commissions (IOSCO), the world forum gathering the Supervisory Authorities of the Financial Markets operating in the various countries [IOSCO Press Release of 3 October 2022].
The primary objective of the campaign is to raise public awareness of the importance of financial education, to promote understanding and autonomy of judgment in making financial decisions in the context of real life. Following past editions, the WIW will give space to key messages on subjects like "smart investors" as well as to current phenomena such as sustainable finance, crypto-assets, and investor resilience, in a particularly challenging context like the current one.
The World Investor Week in Italy will take place in connection with the Month of Financial Education, bringing back to the WIW the bivalent initiatives that will be implemented during the month of October.
The site specifically dedicated to the worldwide campaign - http://www.worldinvestorweek.org - contains general information on the features of the campaign, on its key messages, on the participating Countries and on the resources available. This year the event is also supported by various international organizations, such as, among others, the G20 (Indonesia 2022), the World Bank and the OECD.

The Authority availed itself of the powers deriving from the "Growth Decree" (Law no. 58 of 28 June 2019, Article no. 36, paragraph 2-terdecies), on the basis of which Consob can order Internet connectivity service providers to inhibit access from Italy to the websites through which financial services are offered without due authorization.
