CONSOB notification on omissions and/or significant issues under EMIR reporting pursuant to Article 9, paragraph 1 of Commission Implementing Regulation EU n. 1860/2022

Pursuant to Article 9, paragraph 1 of Commission Implementing Regulation EU n. 1860/2022 entities responsible for reporting should notify Consob of omissions and/or significant errors in reporting under Article 9 of EMIR in the following instances:

(a) any misreporting caused by flaws in the reporting systems that would affect a significant number of reports;

(b) any reporting obstacle preventing the report submitting entity from sending reports to a trade repository within the deadline referred to in Article 9(1) of Regulation (EU) No 648/2012;

(c) any significant issue resulting in reporting errors that would not cause rejection by a trade repository in accordance with Commission Delegated Regulation (EU) 2022/1858.

CONSOB notification should be submitted to the certified email address dme@pec.consob.it and to the regular email address post-trading@consob.it using the following ESMA template. Filling instructions are included in the forms.

Non-Italian resident entities should submit the notification exclusively to the regular email address post-trading@consob.it.
