    Consob has ordered the black-out of 7 new websites through which financial services and products are abusively provided:  6 abusive financial intermediation websites and 1 website through which an offer of financial products is carried out in the absence of a prospectus.

    The Authority made use of the powers deriving from the "Growth Decree" ("Decreto crescita" - Law No. 58 of 28 June 2019, Article No. 36, paragraph 2-terdecies), regarding the blacking out of the websites of abusive financial intermediaries, as well as of the power introduced by Law No. 8 of 28 February 2020, Article No. 4, paragraph 3-bis, regarding the blacking out of the website by means of which the abusive offer is carried out.

    Consob has issued a Warning (available only in Italian) to savers about the growing spread of the phenomenon of fake online job offers by which the performance of generic activities (such as, for example, clicking links, subscribing to websites, putting likes on commercial products/services, writing reviews and the like), linked to the performance of transactions on crypto currencies from which an additional opportunity to earn money would arise (the so-called task scam). These proposals, conveyed mainly through social networks, induce users to operate through websites that can be traced back to abusive service providers on crypto currencies and take the form of deceptive initiatives aimed at acquiring the users' own money and personal data.

    Consob, in countering this phenomenon, has also ordered, pursuant to the European discipline on crypto-assets (Mica Regulation) the blacking out of four websites through which services for crypto-assets were provided to Italian savers in the lack of the prescribed authorizations.

    Warning notice to the potential risks associated with the activity of financial influencers (so-called finfluencers)

    CONSOB (Commissione Nazionale per le Società e la Borsa) draws the attention of savers to the potential risks arising from the activity of online financial influencers (finfluencers), well-known or very popular persons on the web who spread content relating to possible investments and to the rules to which the dissemination of online financial content is subject.

    Savers who access the content shared by finfluencers must avoid making investment decisions hastily, solely on the basis of what others are doing (‘herd effect’) or on the emotional pull of generic and unverified information about the type of investment and the person providing it. It is necessary to be wary of alleged investment opportunities that are presented as highly profitable and risk-free for limited outlays: it must always be remembered, in fact, that financial investments involve the assumption of a certain degree of risk. Particular attention must also be paid to possible conflicts of interest on the part of those who disseminate information with respect to the investments being assessed. Investment decisions must be made in an informed and conscious manner, paying the utmost attention.

    Finfluencers must be aware that their operations may not be fully compliant with market regulations or unauthorized at all, as also recently highlighted by IOSCO. Savers must check the obligations and prohibitions in force, with particular reference to the rules on the correct presentation of information that may constitute investment recommendations, under market abuse rules, and the transparency of any situations of conflict of interest. These rules are very tight with relation to information disseminated by persons introducing themselves as "experts", for the application of which reference is also made to the ESMA communication: "Warning ESMA on Social Media and Investment Recommendations". The dissemination of false or misleading information may also lead to unlawful acts falling within the category of market manipulation provided for by the regulation on market abuse with reference to both financial instruments and crypto-assets.

    The aspects outlined here do not exhaust the profiles worthy of attention in relation to the activities of finfluencers. CONSOB continues its daily supervision of compliance with the applicable regulations, also in the digital environment, to ensure the protection of savers and integrity of the markets.

    Consob has ordered the black out of the https://giorgetti-invest.com website, which "was cloning" the image of the Minister of the Economy, Giancarlo Giorgetti. Through fake interviews apparently given to leading television programmes, the Minister's "clone" advertised investment services provided via abusive trading platforms.    

    Consob's action - to protect retail investors and the Minister himself, who had absolutely nothing to do with the matter - was carried out, by exercising the powers deriving from the "Growth Decree" (converted by Law no. 58 of 28 June 2019) and the "Capital Law" (Law no. 21 of 5 March 2024).

    In recent months, Consob has carried out similar actions on sites that illegally referred to the Prime Minister, Giorgia Meloni, and the President of the Republic, Sergio Mattarella (Consob press release of 12 December 2024).

    At the same time, Consob has also blocked six other abusive financial intermediation sites.

    Warning ESMA - Factsheet titled “Using Artificial Intelligence for Investing: What you should consider”

    The use by the public of tools powered by artificial intelligence (AI) is becoming more and more popular, including in the context of financial investing. Investors have access to public online AI tools and applications (apps) that can suggest investments based on publicly available knowledge. However, these technologies - while innovative and potentially useful - also present significant risks, especially when used as the sole source for making financial decisions.

    The factsheet released today by ESMA and national Authorities aims to raise awareness of the main issues to keep in mind when using publicly available AI tools for investment guidance. It highlights the potential dangers of misleading advice, promises of easy money, lack of regulatory oversight, and privacy risks.

    Consob's interventions in the crypto-assets sector continue due the powers granted by the European sector regulation (Micar).

    Consob has ordered the termination of the abusive offer of crypto-assets called "memecoin $CORONA," at the Italian public, which was also promoted through the website www.getcoronamemes.com, lacking previous notification to Consob of the disclosure document (white-paper) required by Micar.

    Six websites through which cryptocurrency services were provided without the required authorizations from Micar were, in addition, blocked:

    Watch for “scams squared”: from Consob a warning on the risks of fake debt collection to those who have already been scammed.

    The National Commission for Companies and the Stock Exchange warns savers about the risks arising from the activities of unspecified subjects who, presenting themselves as lawyers, through telephone contacts and the website https://studiolegaleagnelli.it, improperly use the logo and name of CONSOB, AGCOM and AGCM and pretend to have been commissioned by CONSOB to recover sums previously lost by savers as a result of investments made through financial trading websites.

    It is a well-known fraud technique, for which ESMA has also issued a warning [link: https://www.esma.europa.eu/investor-corner/frauds-and-scams]. The agents of these deceptive initiatives claim that CONSOB, whose representatives and employees are also improperly nominated in some circumstances, can assist victims of financial fraud to recover or “unlock” lost money.

    The authors of such initiatives ask victims for a fee or payment of a “tax” but, afterwards, they seize these sums from savers without providing any service.

    Savers are warned, therefore, that these activities, are in no way referable to CONSOB (which does not deal with debt recovery) nor have they been authorized by CONSOB.

    In recommending again the utmost caution, CONSOB suggests to look at the section of its institutional website (www.consob.it) called “Watch for scams!” and, in particular, the previous communications to protect savers regarding the so-called fake debt collection practice and the unauthorized use of the Consob logo.

    Whatsapp frauds with the illicit use of well-known brands in the financial sector - Consob issues alert on the spread of the phenomenon

    Consob warns savers of the risks associated with investment proposals, delivered mainly through variously named WhatsApp groups and channels, which by unduly leveraging the notoriety of the brands "Morgan Stanley," "BlackRock" or other leading players in the financial sector prospect unrealistic earning opportunities related to alleged investments that, even by means of the alleged use of artificial intelligence programs, would allow to replicate the transactions carried out by "institutional investors."

    The Regulatory Authority of New Zealand, warns savers that a scam is underway through which false term deposits are being offered using the name of Co-operative Bank.

    The scammers pose as Co-operative Bank employees and send false product disclosure statements using the bank's name, logo, address and registration details.

    Co-operative Bank has confirmed that it is not connected to these offers. Co-operative Bank also confirmed that it directs its customers to the bank's website to view and download documents such as the prospectus. When in doubt, customers should check the details on Co-operative's website or contact the bank to confirm.

    Fma recommends that investors contact the relevant bank or financial institution through verified channels before investing money.

    The Cyprus Supervisory Authority, the Cyprus Securities and Exchange Commission ("CySEC") warns savers that false and misleading posts have been identified in electronic and social media in which well-known political figures and/or artists claim to have invested and/or recommend investment products through which high returns would be possible. These false and misleading posts aim to deceive and defraud the public and are unrelated to the public figures presented as investors/advisers. CySEC investigated a number of these false and misleading posts on social media and confirmed that they do not belong to entities or individuals licensed to provide investment services. CySEC urges the public to be especially cautious and make sure that any person or entity they are in contact with is licensed to provide investment services in Cyprus and is therefore acting in compliance with investor protection regulations. Furthermore, in the event of a dispute with an unauthorized entity, the public will not have access to out-of-court settlement procedures. In such a case, it will be necessary to apply to the police and the courts for redress.

    It is possible to check whether a company is authorized to provide investment services in Cyprus by visiting the CySEC website (cysec.gov.cy).

    CySEC also warns savers that it has become aware of the existence of the website "cysecgov.org," which was created maliciously and does not belong to CySEC. In addition, the e-mail address "supportcenter@cysecgov.org" mentioned on the aforementioned website does not belong to CySEC. In addition, the website "cysecgov.cc" was also maliciously created and does not belong to the Authority.

    CySEC would like to warn the investing public that through these websites and emails, individuals fraudulently present themselves as officials or representatives of CySEC, approaching investors and soliciting fees in exchange for alleged agreements to recover losses incurred as a result of their investments made through companies under CySEC's supervision.

    To help the public identify and avoid fraudulent traders, CySEC would like to remind the public that:

    - CySEC never contacts individuals by phone or sends unsolicited correspondence and does not request personal data, financial or other information;

    - Investors are encouraged to contact CySEC to confirm the authenticity of communications by emailing info@cysec.gov.cy before taking any action and to inform CySEC of any suspicious activity of which they become aware;

    - CySEC's authentic emails include addresses ending with cysec.gov.cy, although, there have been cases where scammers have disguised their web addresses by including the authentic one;

    - CySEC has no authority or mandate to collect fees for any purpose from individual investors, nor does it have the authority to appoint anyone to do so on its behalf;

    - CySEC does not authorize, verify, monitor, or engage in any way in class actions, compensation schemes, payments between natural or legal entities, or public or private organizations;

    - CySEC issues multiple notices and regular updates regarding unregulated entities and impersonations of CySEC representatives, which can be found among CySEC notices;

    - Guidance for investors on how to spot financial scams can be viewed on the official Cysec website.

    Finally, CySEC urges the public to remain vigilant and cautious of any unwanted communications that appear to come from the Authority and to refrain from sending money to anyone claiming to represent it.

    Consob has ordered the black-out of 5 new websites that offer financial services illegally.

    The commission availed itself of the new powers resulting from the "Decreto Crescita" ("Growth Decree"; Law no. 58 of 28 June 2019, Article 36, paragraph 2-terdecies), on the basis of which Consob can order internet service providers to block access from Italy to websites offering financial services without the proper authorisation.

    Below are the sites Consob has ordered to be blacked out:

    - "Krakcoin Trading" (website www.krakcoin.co);

    - Europe Investment Group Ltd (websites https://euroinvestgroup.co and https://euroinvestgroup.limited and its related pages https://cfd.euroinvestgroup.co and https://cfd.euroinvestgroup.limited);

    - FX-Rocket Ltd and FX-Rocket Private Bank (website and its pages and);

    - "IBSasset" (website https://ibsasset.co).

    The number of sites blacked out since July 2019, when Consob was given the power to order the black-out of websites of fraudulent financial intermediaries, has thus risen to 1130.

    The measures adopted by Consob can be consulted on the website www.consob.it.

    The black-out of these websites by internet service providers operating on Italian territory is ongoing. For technical reasons, it can take several days for the black-out to come into effect.

    Consob draws investors' attention to the importance of adopting the greatest diligence in order to make informed investment choices, adopting common sense behaviours, essential to safeguard one's savings: these include, for websites that offer financial services, checking in advance that the operator with whom you are investing is authorised, and, for offers of financial products, that a prospectus has been published.

    Please note, there is a section on the homepage of the website www.consob.it, entitled "Watch for Scams!", which provides useful information warning investors about fraudulent financial schemes.

    Communication Consob for investor protection

    Consob has received reports regarding the spread of a phenomenon known as “funded trading”, “financed trading accounts” or “shadow investment game” that involves companies that define themselves as “proprietary firms” (or, in short, “prop firms”).

    According to the scheme that emerged, savers would be offered online training courses and/or financial information services essentially useful for allowing them to carry out trading operations in a simulated, trial environment, without using their own capital, on demo accounts activated for savers at foreign companies that define themselves as “proprietary firms” or “prop firms”.

    The “prop firms” then offer savers the opportunity to carry out the theoretically best performing virtual trading operations, and which therefore exceed the so-called trading challenges specifically organised, the possibility of seeing these virtual operations replicated on real trading platforms, using the accounts opened by the same “prop firms” with their capital, for the alleged purpose of generating earnings to be shared with savers.

    In spite of that which is proposed to savers, the described operating scheme exposes them to various risks as it requires an outlay of money for the use of a training course and/or subscription to a financial information service, as well as the passing of a test (challenge) that would give the saver the opportunity to see their trading operations replicated, actually carried out, by the “prop firms”.

    But the challenge is designed in such a way that it is not easily overcome and there may be an increasing level of difficulty of the trading challenges to be accessed with further outlays from savers.

    From the reports received, it has emerged that the savers who have adhered to these initiatives, for example, by paying for training courses and/or for a financial information service, have not been paid any economic benefit by the “prop firms”.

    Moreover, these risks are amplified by the gaming effect inherent to challenges and the widespread presence of the phenomenon on social media also due to the activity of third parties that promote “prop firms”.
